In 1999 parliament passed legislation to repeal the Workers’ Compensation Cap 271 and the Pneumoconiosis Compensation Cap 217 in order to merge the two schemes which operated independently hitherto. The repealing of the two Acts resulted in the current Workers’ Compensation Act No. 10 of 1999 of the Laws of Zambia.
Prior to the merger, the Workers’ Compensation Board was responsible for accidents and scheduled diseases arising out of and in the course of employment while the Pneumoconiosis Compensation Board was responsible for lung diseases caused by silica in the mines.
The Workers’ Compensation Act No. 10 of 1999 of the Laws of Zambia provides the legal framework governing the establishment and administration of the Workers’ Compensation Fund Control Board. This Act is intended to provide for:
Compensation of workers for disabilities suffered or diseases contracted during the course of employment;
The merger of the functions of the Workers’ Compensation Fund Control Board and the Pneumoconiosis Compensation Board;
The establishment and administration of the Fund for the compensation of workers disabled by accidents occurring, or diseases contracted in the course of employment;
Payment of compensation to dependants of workers who die as a result of occupational accidents or diseases
The payment of contributions to the Fund by employers;
The appointment and powers of a Workers’ Compensation Commissioner, the establishment and functions of a Workers’ Compensation Tribunal; and to provide for matters connected with and incidental to the foregoing.
To strive towards service excellence in providing social security services.
To effectively, efficiently and professionally administer a quality employment injury and occupational disease scheme that embraces service excellence in the provision of compensation to all beneficiaries.
